1. Acceptance of Terms

By creating an account, accessing, or using Bakebug ("we", "us" or "Bakebug"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not create an account or use the platform.

2. Eligibility and Age Requirement

You must be at least 18 years old (the "age of majority") in your jurisdiction to register for and use Bakebug independently. If you are under 18, you may only use Bakebug with the involvement and explicit consent of a parent or legal guardian who agrees to be responsible for the account and any transactions processed through it. By creating an account, you represent and warrant that you meet this eligibility requirement.

3. User Accounts

Accounts are created using third-party authentication (for example, Google or Facebook). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Services & Responsibilities

Bakebug provides an online platform for individuals and small businesses (for example, home bakers) to create and operate online stores ("Services"). Store Owners are solely responsible for:

  • Complying with all applicable laws, regulations, and local health & safety requirements.
  • Collecting and remitting any required taxes.
  • Fulfilling orders and customer service obligations.
  • All content posted to their store (product listings, images, descriptions, pricing).
  • Obtaining any necessary business licenses, permits, or certifications required in their jurisdiction.

Bakebug is a platform provider only and is not a party to transactions between Store Owners and their customers.

5. Payments & Third-Party Processors

Payments are handled by third-party payment processors (for example, Square). Bakebug does not directly process card payments or handle sensitive cardholder data. Payment processors perform their own identity verification (KYC) and may refuse to enable payments for accounts that do not meet their requirements (including due to age or other eligibility restrictions).

Bakebug does not guarantee that payment processing will be available for all users. Payment processors may deny service based on their own eligibility criteria, which are independent of Bakebug's account eligibility requirements. Store Owners are responsible for maintaining compliance with payment processor terms and for resolving any payment disputes directly with the processor.

6. User Content & Conduct

You are solely responsible for any content you submit, post, or transmit through the Services. You grant Bakebug a worldwide, non-exclusive, royalty-free license to host, display, and transmit content as necessary to provide the Services. You represent and warrant that you own or have the necessary rights to all content you submit and that your content does not violate any third-party rights or applicable laws.

You agree not to use the Services for unlawful purposes, to post prohibited or harmful content, or to engage in fraudulent activities. We reserve the right to remove content and terminate accounts that violate these Terms.

7. Limitation of Liability & Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BAKEBUG PROVIDES THE SERVICES "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. BAKEBUG DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BAKEBUG DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED. YOU USE THE SERVICES AT YOUR OWN RISK.

IN NO EVENT WILL BAKEBUG, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER (INCLUDING LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BAKEBUG'S AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS SHALL BE LIMITED TO THE TOTAL FEES PAID BY YOU TO BAKEBUG FOR THE SERVICES IN THE PRIOR TWELVE (12) MONTHS, OR ONE HUNDRED CANADIAN DOLLARS (CAD $100), WHICHEVER IS GREATER. SOME JURISDICTIONS MAY NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

8. Indemnification

You agree to indemnify, defend, and hold Bakebug and its affiliates, officers, directors, employees, and agents harmless from any claims, demands, damages, liabilities, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the Services; (b) your breach of these Terms; (c) your violation of applicable law; (d) your content; or (e) transactions between you and your customers.

9. Termination

We may suspend or terminate accounts that violate these Terms, engage in fraud, abuse the platform, or otherwise harm the Services or other users. We may also terminate or suspend the Services at any time with or without notice. You may stop using the Services at any time by closing your account.

Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination (including limitations of liability, indemnification, and dispute resolution) will continue to apply.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the Services shall be resolved in the courts located in Ontario, Canada. However, applicable consumer protection laws in your jurisdiction may provide you with additional rights that cannot be waived by these Terms.

11. Country Support & Geolocation

Bakebug currently supports users in Canada, the United States, the United Kingdom, and Ireland. We attempt to detect a user's country for localization, timezone defaults, and user experience purposes using IP-based geolocation services and browser locale information. This detection is provided for convenience only and is not a substitute for legal eligibility checks or verification. Users and Store Owners remain solely responsible for complying with all local laws and eligibility requirements applicable to their activities, regardless of detected location.

12. Changes to Terms

We may modify these Terms from time to time. Updated Terms will be posted on this page with a revised "Last Updated" date. Material changes may be communicated via email or prominent notice on the platform. Continued use of the Services after updates constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
